Adoptables ToS
These Terms of Service (“Terms”) govern your purchase and use of art adoptables (“Adopts”) from CoffeeTechNerd (“Seller”). By purchasing an Adopt, you agree to these Terms.
1. Definitions:
- Adopt: A digital or physical artwork depicting an original character or design, offered for sale by the Seller.
- Buyer: The individual or entity purchasing an Adopt.
- Personal Use: Non-commercial use, including but not limited to character development, role-playing, personal artwork, and displaying the Adopt on personal social media.
- Commercial Use: Use of the Adopt for profit, including but not limited to merchandise, advertising, and commercial projects.
- Original Artwork: The artwork provided by the Seller at the time of purchase.
2. Ownership and Copyright:
- The Seller retains the copyright to the original artwork of the Adopt.
- Upon purchase, the Buyer acquires ownership of the character design and the right to use the Adopt for Personal Use, unless otherwise stated.
- Commercial Use may be granted on a case-by-case basis and may require additional fees and a separate agreement.
3. Permitted Uses:
- Personal Use:
- The Buyer may use the Adopt for personal character development, role-playing, and storytelling.
- The Buyer may display the Adopt on personal social media and websites, provided proper credit is given to the Seller.
- The Buyer may commission artwork of the Adopt from other artists, provided they respect the original design.
- Minor edits to the design are acceptable, as long as it stays true to the original design.
- Commercial Use (If Granted):
- The specific terms of Commercial Use will be outlined in a separate agreement.
- The Buyer must credit the Seller as the original designer in all commercial applications.
4. Prohibited Uses:
- The Buyer may not claim the original artwork as their own.
- The Buyer may not resell the original artwork itself.
- The Buyer may not use the Adopt for any hateful, discriminatory, or illegal purposes.
- The Buyer may not create NFTs of the adopt without explicit written permission from the seller.
- Reverse engineering the design for commercial resale is prohibited.
- Using the adopt for AI training is prohibited.
5. Payment and Delivery:
- Payment is due in full before the delivery of the Adopt.
- Payment is to be made in full within 48 hours, otherwise the adopt will be placed back up for sale.
- Payment methods accepted will be specified by the Seller; if you are purchasing the adopt is on DeviantArt, that is where the payment will be made. No external sales. If the adopt is on this site, you will pay on this site via my PayPal link.
- Delivery of digital Adopts will be made electronically, typically via email or a download link.
- Delivery of physical Adopts will be made through a shipping service, and shipping costs will be the Buyer’s responsibility.
6. Refunds and Returns:
- Refunds or returns may be considered on a case-by-case basis at the Seller’s discretion.
- Digital Adopts are generally non-refundable once delivered.
- If a physical adopt is damaged during delivery, the buyer must provide photographic proof of damage, and the seller will determine a solution.
7. Modifications to these Terms:
- The Seller reserves the right to modify these Terms at any time.
- Any changes will be posted on the Seller’s website or social media.
- It is the Buyer’s responsibility to review these Terms periodically.

By purchasing an Adopt, you acknowledge that you have read, understood, and agree to these Terms of Service.
